Instructor Terms | Real Drive

These Instructor Terms and Conditions ("Instructor Terms") apply when you register, operate or provide driving instruction through Real Drive as a driving instructor.

Real Drive is operated by Professional Service Support Limited, trading as Real Drive.

These Instructor Terms should be read together with the Real Drive Terms of Service, Privacy Policy and any additional commercial, booking or service-specific terms that apply to you.

By registering as an instructor, accepting these Instructor Terms or providing services through Real Drive, you agree to comply with them.

1. Your Status as an Independent Instructor

You provide driving instruction as an independent, self-employed driving instructor.

Nothing in these Instructor Terms creates an employment relationship, worker relationship, partnership, agency or joint venture between you and Real Drive unless the law requires otherwise.

You remain responsible for operating your own driving-instruction business, including your own legal, tax, regulatory and professional obligations.

Except where expressly authorised, you must not represent yourself as an employee or legal representative of Real Drive.

2. Eligibility to Provide Driving Instruction

You must at all times maintain the licences, registrations, approvals and other legal requirements necessary for the services you provide.

Depending on your instructor status, this may include:

A valid driving licence;
Valid Approved Driving Instructor (ADI) registration;
Valid Potential Driving Instructor (PDI) authority where applicable;
Compliance with applicable DVSA requirements;
Appropriate motor insurance covering driving instruction;
Any legally required vehicle documentation;
DBS or other checks where applicable;
Any other legally required authorisation.

You must promptly notify Real Drive if:

Your ADI/PDI status changes;
Your registration expires, is suspended or restricted;
Your driving licence becomes invalid or restricted;
Your insurance expires, is cancelled or materially restricted;
You become subject to relevant regulatory action;
You are no longer legally entitled to provide driving instruction;
Another material circumstance affects your ability to provide lessons safely or lawfully.

You must not accept or provide lessons through Real Drive while you do not have the required legal entitlement.

3. Verification

Real Drive may require information and documentation to verify your identity, instructor status and eligibility.

This may include:

Full name;
Contact details;
Identity information;
Driving licence information;
ADI/PDI information;
Instructor registration details;
Vehicle information;
Insurance information;
DBS or other verification information where applicable;
Bank or payout information;
Service areas;
Other reasonably necessary information.

You must provide accurate, genuine and current information.

Real Drive may periodically require updated documentation.

Real Drive may restrict or suspend your instructor profile where required documentation is missing, expired, invalid or cannot reasonably be verified.

Approval or verification by Real Drive does not remove your responsibility to maintain your own legal and professional requirements.

4. Your Tuition Vehicle

Where you provide instruction using your own vehicle, you are responsible for ensuring that it:

Is legally roadworthy;
Is appropriately insured for driving instruction;
Has a valid MOT where required;
Is appropriately taxed where required;
Is properly maintained;
Meets applicable legal and regulatory requirements;
Is suitable and reasonably safe for learner tuition.

You are responsible for servicing, maintenance, repairs and other vehicle-related costs unless separately agreed otherwise.

Real Drive may request evidence relating to your vehicle and insurance.

You must promptly update relevant vehicle information where you change the vehicle used for Real Drive lessons.

5. Your Real Drive Profile

Real Drive may provide you with a public instructor profile.

Your profile may contain:

Name;
Photograph;
Biography;
ADI/PDI status;
Experience;
Vehicle information;
Vehicle type;
Lesson prices;
Service areas;
Languages;
Availability;
Reviews and ratings;
Other information relevant to learners.

You are responsible for ensuring that information you provide is accurate and kept reasonably up to date.

You must not provide false or misleading information.

Real Drive may correct, restrict or remove profile information where reasonably necessary to protect users, comply with law or maintain platform standards.

6. Availability and Service Areas

You may be able to configure your availability and the geographical areas in which you provide lessons.

You are responsible for keeping this information reasonably accurate.

You should not intentionally make times available where you know you cannot provide lessons.

Availability displayed on Real Drive does not necessarily create a confirmed booking until the applicable booking process has been completed.

You remain responsible for considering reasonable travel time between lessons.

7. Providing Lessons

You are responsible for the driving instruction you provide.

You agree to:

Provide lessons professionally and safely;
Arrive at the agreed location at the agreed time;
Provide appropriate tuition having regard to the learner's ability and circumstances;
Follow applicable road traffic laws;
Follow applicable DVSA requirements;
Maintain appropriate professional boundaries;
Treat learners fairly and respectfully;
Provide reasonable feedback;
Maintain appropriate records where necessary;
Take reasonable steps to protect learners and other road users.

You must not knowingly provide unsafe or unlawful driving instruction.

8. Learner Safety and Fitness to Drive

You must exercise reasonable professional judgement concerning whether a lesson can safely and lawfully proceed.

You may refuse to begin or may stop a lesson where you reasonably believe that the learner:

Is under the influence of alcohol or drugs;
Is otherwise materially unfit to drive;
Does not have the required legal entitlement;
Creates a serious safety risk;
Refuses reasonable safety instructions;
Behaves abusively or threateningly;
Makes continuing the lesson unsafe or unlawful.

Where appropriate, you should explain why the lesson cannot proceed.

Serious safety concerns or incidents connected with a Real Drive booking should be reported to Real Drive where reasonably necessary.

9. Lesson Bookings

Bookings may be created, requested or proposed through Real Drive.

You are responsible for reviewing relevant booking information before accepting or confirming a lesson.

Once you accept or confirm a booking, you should honour it unless there is a legitimate reason why the lesson cannot proceed.

You should keep your Real Drive booking information and availability reasonably current to reduce scheduling conflicts.

You must not deliberately create overlapping bookings that you cannot fulfil.

10. Instructor-Created Bookings

Where Real Drive allows you to create a booking for a learner, you must ensure that:

The learner has agreed to the lesson;
The date and time are accurate;
The lesson duration is correct;
The applicable lesson pack or payment arrangement is correctly selected where relevant;
The booking does not knowingly conflict with another commitment.

You must not create false or unauthorised bookings.

11. Cancellations and Rescheduling

You should provide reasonable notice when cancelling or rescheduling a confirmed lesson.

Where you cancel a lesson, the learner should not normally be charged for instruction that was not provided.

Where lesson-pack or intensive-course hours were allocated to a lesson that you cancel, those hours should normally be returned to the learner's available balance in accordance with Real Drive's applicable rules.

Where a learner cancels or fails to attend, the applicable learner cancellation policy may determine whether:

The lesson remains chargeable;
Pack hours are deducted;
Intensive-course hours are deducted;
A cancellation payment is due to you.

You must not falsely record a completed lesson or learner cancellation in order to obtain payment.

Repeated instructor cancellations, non-attendance or booking abuse may result in review, restriction or suspension.

12. Lesson Prices

Real Drive may allow you to set or agree prices for services you provide.

You are responsible for ensuring that prices you submit are accurate.

Where a price has been confirmed for a booking, you must not demand a different price from the learner unless the change has been properly agreed and permitted through Real Drive.

You must honour applicable promotions or discounts that you have agreed to participate in.

Real Drive may establish pricing rules or restrictions for particular services.

13. Lesson Packs

Real Drive may allow learners to purchase prepaid lesson packs.

Where you provide a lesson using a valid pack:

The applicable lesson duration may be deducted from the learner's available pack balance;
You must accurately record whether the lesson took place;
You must not charge the learner separately for hours already covered by the pack unless another legitimate charge has been clearly agreed;
Cancellation treatment will follow the applicable Real Drive cancellation rules.

Your entitlement to earnings from pack lessons will be calculated according to the applicable Real Drive commercial arrangement.

You do not acquire ownership of a learner's unused prepaid hours merely because you are their current instructor.

14. Intensive Driving Courses

Real Drive may offer intensive driving courses and may make course opportunities available to instructors.

An intensive-course opportunity may specify information including:

Course hours;
General location;
Learner requirements;
Vehicle requirements;
Proposed instructor payment;
Scheduling information;
Other relevant conditions.

You may be able to accept an opportunity, submit a bid or be assigned by Real Drive.

Submitting a bid does not guarantee that you will receive the assignment.

Where you accept or are assigned an intensive course, the applicable assignment details will determine your allocated course hours and payment arrangements.

You should only accept an intensive-course assignment where you reasonably expect to be able to provide the allocated tuition.

You must accurately record lessons delivered against the course.

Completed lessons reduce the learner's remaining course hours.

You must not claim hours that were not genuinely provided or otherwise legitimately chargeable under the applicable cancellation terms.

Real Drive may reassign some or all remaining course hours where reasonably necessary, including where:

You cannot complete the assignment;
Your availability materially changes;
The learner reasonably requires reassignment;
There are serious complaints or safety concerns;
Your instructor status or insurance becomes invalid;
Your Real Drive participation is suspended or terminated.

An intensive-course assignment does not make you an employee or worker of Real Drive merely because Real Drive arranged or allocated the course.

15. Practical Driving Tests

You may provide test preparation and may agree to provide your tuition vehicle for a learner's practical driving test.

You must not guarantee that a learner will pass.

You should provide an honest professional assessment of the learner's readiness.

You are not required to provide your vehicle for a practical test where you reasonably believe doing so would be unsafe, unlawful or inappropriate.

Where reasonably possible, concerns about test readiness should be communicated to the learner sufficiently early for them to consider their options.

16. Learner Progress

You may be required or permitted to record learner progress through Real Drive.

Progress records should be honest and based on your reasonable professional assessment.

You must not deliberately falsify:

Lesson completion;
Lesson duration;
Skills covered;
Learner progress;
Test readiness;
Other tuition records.

Progress information may be visible to the learner through Real Drive.

17. Payments and Instructor Earnings

Real Drive may collect payments from learners and account to you for amounts due under the applicable commercial arrangement.

Your instructor earnings may be calculated based on factors including:

Lessons provided;
Lesson duration;
Lesson-pack arrangements;
Intensive-course assignments;
Applicable cancellation payments;
Platform fees or commission;
Refunds;
Adjustments;
Other agreed amounts.

Amounts displayed as pending, scheduled or estimated earnings are not necessarily available for withdrawal.

Real Drive may make reasonable corrections where an earning has been recorded incorrectly.

You must not manipulate bookings, lesson statuses, cancellations or other records in order to obtain money to which you are not entitled.

18. Platform Fees and Commission

Real Drive may charge instructors fees in accordance with the commercial arrangement applicable to their account or service.

These may include:

Commission;
Platform fees;
Subscription fees;
Referral fees;
Payment-processing charges;
Other agreed charges.

Applicable charges should be communicated separately or displayed through Real Drive where appropriate.

Real Drive may deduct legitimately applicable amounts from payments collected through the platform.

Where Real Drive materially changes an ongoing commercial arrangement, reasonable notice will be provided where appropriate.

19. Instructor Wallet and Withdrawals

Where Real Drive provides an instructor wallet or earnings balance, the balance may represent amounts recorded as payable to you through the platform.

You may request withdrawal of eligible available funds subject to:

Any applicable minimum or maximum withdrawal amount;
Identity or security verification;
Valid payout or bank information;
Fraud and compliance checks;
Outstanding refunds, disputes or adjustments;
Other applicable payout requirements.

Submitting a withdrawal request does not necessarily mean that payment has been completed.

A withdrawal may be pending while it is reviewed or processed.

Where a withdrawal request is rejected or cancelled before payment is completed, the applicable amount may be returned to your available Real Drive balance.

You are responsible for providing accurate payout information.

Real Drive is not responsible for delays or losses resulting from incorrect payout information supplied by you, except where applicable law provides otherwise.

20. Refunds, Disputes and Adjustments

Real Drive may need to make refunds, payment corrections or other adjustments relating to bookings you provided.

Where appropriate under the applicable commercial arrangement, an amount may be deducted or adjusted where:

A learner receives a valid refund;
A payment is reversed;
A transaction was recorded incorrectly;
A lesson was incorrectly marked as completed;
Fraud or misuse occurred;
Another legitimate adjustment is required.

Real Drive will not make arbitrary deductions from instructor earnings.

Where reasonably appropriate, information about an adjustment will be made available to you.

21. Direct Bookings and Circumvention

You may operate a legitimate driving-instruction business independently of Real Drive.

However, you must not intentionally use Real Drive to obtain learners and then move Real Drive-generated bookings or payments outside the platform solely to avoid legitimately applicable Real Drive fees or commercial arrangements.

Any specific restrictions relating to learners introduced through Real Drive should be set out in the applicable commercial arrangement.

Nothing in these Instructor Terms prevents you from conducting genuinely independent business that does not breach an applicable agreement or legal obligation.

22. Communication With Learners

You may receive learner contact or booking information where necessary to provide lessons.

Communication should remain professional and reasonably related to legitimate purposes.

You must not:

Harass or threaten learners;
Send discriminatory or abusive communications;
Use learner information for unrelated purposes without an appropriate legal basis;
Send unlawful marketing;
Share learner information with unauthorised people;
Use communications to facilitate fraud or other unlawful activity.

23. Professional Conduct

You must maintain appropriate professional standards when providing services connected with Real Drive.

You must not:

Behave abusively, aggressively or threateningly;
Harass or intimidate a learner;
Unlawfully discriminate;
Make inappropriate sexual comments or advances;
Exploit a learner;
Misuse learner information;
Deliberately make false claims about Real Drive;
Engage in fraudulent or seriously dishonest behaviour;
Engage in conduct connected with Real Drive that creates a serious safety risk.

Serious allegations may result in temporary suspension while Real Drive reasonably investigates the matter.

24. Reviews and Ratings

Learners may be able to review and rate services they receive.

You must not:

Create fake reviews;
Submit reviews while impersonating a learner;
Manipulate ratings;
Pressure or threaten a learner concerning a review;
Offer inappropriate incentives in exchange for a positive review;
Retaliate against a learner for leaving a genuine review.

You may raise a concern with Real Drive where you reasonably believe that a review is fraudulent, unlawful or breaches applicable platform rules.

Real Drive may moderate reviews in accordance with its policies.

25. Complaints

Real Drive may investigate complaints concerning services provided through its platform.

You agree to cooperate reasonably with an investigation.

You may be asked to provide relevant information including:

Booking records;
Lesson information;
Communications;
Payment information;
Progress records;
Your account of what occurred.

Real Drive should consider relevant information fairly before taking significant account action where circumstances permit.

Serious safety, safeguarding, fraud or legal concerns may require immediate temporary action while an investigation takes place.

26. Accidents and Serious Incidents

You must notify Real Drive as soon as reasonably practicable of a serious incident materially connected with a Real Drive booking where Real Drive reasonably needs to know about it.

This may include:

A serious road traffic collision;
Serious injury;
Police involvement;
Significant learner safety concerns;
Serious complaints or allegations;
Relevant regulatory action;
Other significant incidents affecting the Real Drive service.

You remain responsible for reporting matters to your insurer, police, DVSA or another authority where legally required.

Reporting an incident to Real Drive does not replace your own legal or insurance reporting obligations.

27. Insurance

You are responsible for maintaining insurance appropriate to the driving instruction you provide.

You must provide evidence of valid insurance where reasonably requested.

You must promptly notify Real Drive where relevant insurance:

Expires;
Is cancelled;
Is suspended;
Is materially restricted;
No longer covers the driving instruction you provide.

You must not provide lessons through Real Drive without legally required insurance.

28. Data Protection

You may receive personal information about learners through Real Drive.

You must handle that information in accordance with applicable data protection law.

You must use learner information only for legitimate purposes for which you are authorised or otherwise have an appropriate legal basis.

You must take reasonable steps to keep learner information secure.

You must not:

Sell learner personal information;
Disclose it to unauthorised persons;
Use it for unrelated marketing without an appropriate legal basis;
Retain it unnecessarily;
Access learner information without a legitimate reason.

You must promptly notify Real Drive where you become aware of a personal data breach involving information obtained through Real Drive where the breach may affect Real Drive or its users.

Your own business activities may create separate data-protection responsibilities for which you are responsible.

29. Confidentiality

You must keep confidential non-public information obtained through your relationship with Real Drive where the information is reasonably confidential.

This may include information relating to:

Real Drive systems;
Security;
Users;
Commercial arrangements;
Internal operations;
Non-public business information.

You may disclose confidential information where:

Required by law;
Required by a regulator or court;
Reasonably necessary to obtain professional advice;
Necessary to perform your legitimate obligations;
Authorised by Real Drive.

30. Real Drive Brand and Intellectual Property

Real Drive may permit approved instructors to use certain Real Drive branding or promotional material.

Permission to use Real Drive branding does not transfer ownership of that intellectual property to you.

You must follow applicable brand guidelines.

Unless authorised, you must not:

Alter Real Drive logos in a misleading manner;
Register confusingly similar domains or branding;
Claim ownership of Real Drive intellectual property;
Represent yourself as an employee of Real Drive;
Use Real Drive branding in a misleading way;
Continue using branding after permission has ended.

Any permission to use Real Drive branding may end when your participation in Real Drive ends.

31. Marketing Your Instructor Profile

While you are an approved instructor, Real Drive may promote your Real Drive profile and services through channels such as:

The Real Drive website;
Search engines;
Social media;
Online advertising;
Email or other marketing;
Other appropriate promotional channels.

For this purpose, Real Drive may use information that you have provided or authorised for your public profile, including:

Name;
Profile photograph;
Biography;
Service areas;
ADI/PDI status;
Vehicle information;
Lesson information;
Reviews and ratings.

Use of personal information for these purposes is also subject to the Real Drive Privacy Policy and applicable data protection law.

32. Suspension

Real Drive may temporarily restrict or suspend your instructor profile or platform access where reasonably necessary.

Reasons may include:

Expired or invalid documentation;
Loss or uncertainty concerning ADI/PDI status;
Insurance concerns;
Serious learner complaints;
Safety or safeguarding concerns;
Fraud or suspected fraud;
Payment manipulation;
Data-security concerns;
Serious or repeated breach of these Instructor Terms;
Regulatory concerns;
Conduct presenting a material risk to users or Real Drive.

Where appropriate, Real Drive will provide you with an opportunity to respond.

Immediate temporary suspension may be used where reasonably necessary to protect users, preserve evidence, maintain security, comply with law or investigate a serious allegation.

33. Ending Your Participation

You may stop providing services through Real Drive subject to outstanding bookings, payments, assignments and any applicable notice requirements.

Real Drive may terminate your participation where reasonably necessary following serious or repeated breach of these Instructor Terms or another applicable agreement.

Immediate termination may be appropriate in serious circumstances involving:

Loss of legal entitlement to provide instruction;
Serious safety misconduct;
Fraud;
Serious abuse or harassment;
Unlawful activity;
Serious data-protection or confidentiality breach;
Deliberately falsified lessons or payments;
Other material misconduct creating a serious risk to Real Drive or its users.

Termination does not remove obligations or rights that arose beforehand.

Outstanding bookings, learner hours, intensive-course assignments, earnings, refunds, withdrawals and other balances may need to be reconciled following termination.

34. Real Drive's Responsibility

Real Drive is responsible for providing its platform and related services with the level of care required by applicable law.

You remain responsible for the driving instruction you provide and for your own acts and omissions as an independent instructor.

Real Drive is not responsible for losses resulting from your failure to maintain legally required licences, registration, insurance or other professional requirements.

Nothing in these Instructor Terms excludes or limits liability where doing so would be unlawful.

35. Indemnity for Instructor Breach

To the extent permitted by law, you will be responsible for reasonable losses, liabilities, costs or claims suffered by Real Drive that directly result from:

Your unlawful conduct;
Your fraudulent conduct;
Your material breach of these Instructor Terms;
Driving instruction provided without required legal entitlement or insurance;
Your infringement of another person's rights.

This section does not make you responsible for losses caused by Real Drive's own acts or omissions or for amounts for which you cannot lawfully be held responsible.

36. Events Outside Reasonable Control

Neither you nor Real Drive will normally be responsible for delay or failure caused by circumstances genuinely outside reasonable control.

These may include:

Severe weather;
Dangerous road conditions;
Natural disasters;
Road closures;
Vehicle breakdown;
Serious illness or emergencies;
Government restrictions;
Major technical failures;
Significant third-party infrastructure failures;
Industrial action;
Other comparable circumstances.

The affected party should communicate relevant disruption as soon as reasonably practicable.

37. Changes to These Instructor Terms

Real Drive may update these Instructor Terms where reasonably necessary, including because of changes to:

Platform functionality;
Instructor services;
Commercial operations;
Security requirements;
Applicable law or regulation.

Where a change materially affects your rights or obligations, Real Drive will provide reasonable notice where appropriate.

You may be required to accept materially updated Instructor Terms before continuing to provide services through Real Drive.

The current version and last-updated date are displayed with these Instructor Terms.

38. Relationship With Other Real Drive Terms

These Instructor Terms apply specifically to your participation in Real Drive as an instructor.

They should be read together with the Real Drive Terms of Service and Privacy Policy.

Separate commercial arrangements, intensive-course assignment terms or other service-specific terms may also apply.

Where specific terms clearly apply to a particular service or commercial arrangement, those specific terms will apply to that matter to the extent of any conflict.

39. Governing Law

These Instructor Terms are governed by the laws of England and Wales.

Any dispute relating to these Instructor Terms will be subject to the jurisdiction of the courts of England and Wales, except where applicable law requires otherwise.
