These Learner Terms and Conditions ("Learner Terms") apply when you use Real Drive as a learner and when you arrange driving instruction through the Real Drive platform.
Real Drive is operated by Professional Service Support Limited, trading as Real Drive.
These Learner Terms should be read together with the Real Drive Terms of Service, Privacy Policy and any additional terms displayed in connection with a particular booking, lesson pack, intensive course or other service.
By creating a learner account, booking or purchasing a service, or otherwise using Real Drive as a learner, you agree to these Learner Terms.
1. About Real Drive
Real Drive provides a technology platform that helps learners find and connect with driving instructors and manage driving tuition.
The platform may allow you to:
- Search for instructors;
- View and compare instructor profiles;
- Request or book driving lessons;
- Purchase lesson packs;
- Purchase intensive driving courses;
- Communicate with instructors;
- Manage bookings;
- Make payments;
- Track lesson hours and learning progress;
- Receive booking and service notifications;
- Leave reviews and ratings;
- Access other driving-related services.
Unless expressly stated otherwise, Real Drive does not itself provide driving instruction.
Driving instruction is provided by the instructor responsible for your lesson.
2. Learner Eligibility
You must provide accurate, current and complete information when using Real Drive.
You are responsible for ensuring that you meet the legal requirements applicable to any driving instruction or service you book.
Where required, you must hold an appropriate and valid provisional or full driving licence or other legal entitlement to receive driving instruction.
You are responsible for ensuring that your driving entitlement remains valid.
Real Drive or your instructor may request reasonable evidence of your identity, driving licence or driving entitlement.
You must tell your instructor about any licence restrictions or other relevant legal restrictions that affect your ability to drive.
3. Driving Instructors
Driving instructors available through Real Drive may operate as independent, self-employed instructors.
The instructor providing your lesson is responsible for matters relating to the actual provision of driving instruction, including:
- Providing appropriate driving instruction;
- Maintaining the qualifications and legal entitlement required to provide instruction;
- Maintaining appropriate insurance;
- Maintaining their tuition vehicle where applicable;
- Providing tuition with appropriate care and skill;
- Complying with applicable road traffic laws and regulatory requirements.
Real Drive may carry out verification processes relating to instructors.
A verification status means that the relevant Real Drive verification requirements were satisfied when the verification was performed. It does not guarantee an instructor's future conduct, availability, performance or suitability for every learner.
4. Instructor Profiles
Real Drive may display information supplied by or relating to instructors, including:
- Name;
- Profile photograph;
- Biography;
- ADI or PDI status;
- Experience;
- Vehicle type;
- Lesson prices;
- Service areas;
- Languages;
- Availability;
- Reviews and ratings.
Instructor information and availability may change.
You should review the information relevant to you before making a booking.
5. Lesson Bookings
You may request or book driving lessons through Real Drive.
Submitting a booking request does not necessarily mean that the booking has been confirmed.
Where instructor confirmation is required, the booking becomes confirmed when the platform records it as confirmed or you otherwise receive confirmation through Real Drive.
You are responsible for checking:
- The instructor;
- Date;
- Start time;
- Lesson duration;
- Pick-up or meeting location;
- Price;
- Any other important booking information.
You should notify Real Drive or the instructor promptly if you believe booking information is incorrect.
Once a booking has been confirmed, you and the instructor are expected to honour it unless it is cancelled, rescheduled or cannot reasonably proceed.
6. Lesson Prices
The applicable lesson price will normally be displayed before you complete or confirm a booking.
Prices may vary depending on factors including:
- Instructor;
- Lesson duration;
- Vehicle type;
- Location;
- Lesson pack;
- Intensive course;
- Promotion or offer.
The price confirmed for a particular booking will normally apply to that booking.
Changes to an instructor's future prices do not normally change the price of a booking that has already been confirmed, unless you agree otherwise or an obvious pricing error applies.
Promotions and discounts may have additional conditions.
7. Payments
Payments may be processed through Real Drive and its approved payment providers.
Where payment is required, you must provide a valid permitted payment method and authorise the applicable payment.
Depending on the service, Real Drive may:
- Take payment immediately;
- Authorise payment for later capture;
- Use available prepaid lesson hours;
- Use an available platform balance or credit where supported;
- Process a refund or adjustment.
You are responsible for paying amounts legitimately due for services you purchase or use.
Real Drive may refuse, delay or cancel a transaction where reasonably necessary because of suspected fraud, payment security, technical problems or legal requirements.
You must not intentionally circumvent payment arrangements that legitimately apply to services arranged through Real Drive.
8. Lesson Packs
Real Drive may allow you to purchase a prepaid pack containing a specified number of driving-lesson hours.
Before purchasing a lesson pack, you will normally be shown relevant information including:
- Price;
- Number of hours;
- Applicable lesson duration;
- Any expiry period;
- Other important conditions.
When you book a lesson using a pack, the applicable lesson duration will be allocated against your available pack balance.
Completed lessons reduce the remaining available hours.
You cannot normally use more hours than remain available in the pack.
A lesson pack does not guarantee the availability of a particular instructor, date or time.
Where a booked pack lesson is cancelled, rescheduled or missed, the treatment of the allocated hours will depend on the cancellation terms applicable to that lesson.
Any expiry condition will be disclosed where applicable.
9. Intensive Driving Courses
Real Drive may offer intensive driving courses containing a specified number of tuition hours.
Before purchasing an intensive course, you will normally be shown:
- Total course hours;
- Course price;
- Relevant course information;
- Any other important conditions.
Real Drive may arrange or assign an instructor to provide the course.
Instructor assignment may depend on factors including:
- Your location;
- Instructor availability;
- Vehicle type;
- Course requirements;
- Scheduling requirements.
Purchasing an intensive course does not guarantee a particular instructor unless expressly confirmed.
Course hours may be delivered over multiple lessons and dates.
The course schedule may be arranged after purchase and may depend on learner and instructor availability.
Completed lessons reduce the remaining course hours.
Scheduled lessons may reserve part of the remaining course balance.
Cancellation, rescheduling or non-attendance will be handled under the applicable cancellation rules.
Purchasing an intensive course does not guarantee that you will reach driving-test standard within the purchased number of hours.
Every learner develops at a different rate, and additional tuition may be recommended.
An intensive course does not guarantee that you will pass a practical driving test.
10. Cancellations and Rescheduling
You may cancel or request to reschedule a lesson subject to the cancellation terms applicable to the booking.
The applicable cancellation notice period and any cancellation charge should be made available through Real Drive or the relevant instructor terms.
Where you cancel with sufficient notice, any payment, lesson-pack hours or intensive-course hours will be handled according to the applicable cancellation policy.
Where you cancel within an applicable late-cancellation period, some or all of the lesson price or allocated lesson hours may be charged where permitted by the applicable terms and law.
Failure to attend a confirmed lesson without appropriate notice may be treated as a late cancellation or non-attendance.
Where an instructor cancels a confirmed lesson, you should not normally be charged for a lesson that was not provided.
Where prepaid hours were allocated to a lesson cancelled by the instructor, those hours should normally be restored to your available balance.
Nothing in this section limits cancellation or refund rights that you have under applicable law.
11. Refunds, Credits and Unused Hours
Refund entitlement depends on the circumstances and the service purchased.
Unused lesson-pack or intensive-course hours do not automatically entitle you to a full refund.
When determining whether a refund or adjustment is due, relevant factors may include:
- The terms applicable when you purchased the service;
- Hours already used;
- Lessons already provided;
- Applicable cancellation charges;
- Amounts already refunded;
- Any costs lawfully incurred;
- Your statutory consumer rights.
Where a refund is due, Real Drive may return the amount through the original payment method or another appropriate method.
Payment-provider or banking processing times may affect how long a refund takes to appear.
Nothing in these Learner Terms excludes or restricts statutory refund, cancellation or consumer rights that cannot legally be excluded.
12. Pick-Up and Lesson Location
You are responsible for providing accurate pick-up or meeting information where required.
You should be ready at the agreed location at the agreed time.
If you need to change the location, you should notify the instructor as early as reasonably possible.
A requested location change may not always be possible, particularly where it affects timing, travel distance or another booking.
Repeated failure to attend the agreed location may be treated in accordance with the applicable cancellation policy.
13. Your Responsibilities During Lessons
You agree to:
- Arrive on time;
- Follow reasonable safety instructions;
- Provide accurate information about your driving experience;
- Maintain the appropriate legal entitlement to drive;
- Treat instructors and other people respectfully;
- Behave appropriately during lessons;
- Follow applicable road traffic laws;
- Take reasonable steps to protect the safety of yourself and others.
You must not deliberately create an unnecessary safety risk.
You must not intentionally damage or misuse an instructor's vehicle or equipment.
14. Fitness to Drive
You must be fit to drive when attending a lesson.
You must not drive during a lesson if you are impaired in a way that makes driving unsafe or unlawful.
This includes circumstances involving:
- Alcohol;
- Illegal drugs;
- Medication that makes driving unsafe;
- Excessive tiredness;
- Illness or another condition materially affecting safe driving;
- Lack of the required legal entitlement to drive.
You should inform your instructor of relevant circumstances that may affect your ability to drive safely.
An instructor may refuse to begin or may stop a lesson where they reasonably believe that continuing would be unsafe or unlawful.
Where a lesson cannot proceed because you were not fit or legally entitled to drive, applicable cancellation or non-attendance charges may apply.
15. Tuition Vehicles and Safety
Where an instructor provides the tuition vehicle, the instructor is responsible for ensuring that it meets the requirements applicable to their provision of driving instruction.
You must follow reasonable instructions concerning:
- Seat belts;
- Vehicle controls;
- Safe driving;
- Road traffic laws;
- Instructor intervention;
- Vehicle safety.
You should notify the instructor immediately if you become aware of a significant safety problem.
You must not deliberately interfere with safety equipment or intentionally damage the tuition vehicle.
16. Practical Driving Tests
Where agreed with your instructor, the instructor may provide preparation for a practical driving test and may agree to provide a tuition vehicle for the test.
The instructor is not required to provide their vehicle for a practical test merely because you have booked a test.
An instructor may reasonably refuse to provide their vehicle where they believe that:
- You are not sufficiently prepared;
- Your driving presents an unacceptable safety risk;
- Use of the vehicle would be unlawful;
- Insurance or vehicle requirements are not satisfied;
- Another reasonable circumstance prevents use of the vehicle.
You remain responsible for:
- Booking your practical driving test unless another arrangement has expressly been agreed;
- Paying the applicable DVSA test fee;
- Checking your test date and time;
- Attending the correct test centre;
- Bringing required documentation;
- Meeting DVSA eligibility requirements;
- Ensuring that you are legally entitled to take the test.
Neither Real Drive nor an instructor can guarantee that you will pass a driving test.
17. Learning Progress and Test Readiness
Real Drive may provide features for recording or displaying learning progress.
Your instructor may record or provide information relating to:
- Skills covered;
- Areas requiring improvement;
- Lesson progress;
- Recommendations;
- Test readiness.
Progress information is intended to support learning and should not be treated as a guarantee of test success.
An instructor may recommend additional tuition before a practical test.
You remain responsible for decisions concerning your test booking, while recognising that an instructor controls whether they are willing to provide their own tuition vehicle for a test.
18. Communication With Instructors
You may communicate with instructors through communication methods provided or permitted by Real Drive.
You must keep communications lawful and appropriate.
You must not:
- Harass or threaten an instructor;
- Send abusive or discriminatory content;
- Attempt fraud;
- Send spam;
- Misuse another person's personal information;
- Use communication features for unlawful purposes.
Booking-related communications may be processed by Real Drive where necessary to operate and support the platform.
19. Reviews and Ratings
Real Drive may allow you to review or rate an instructor or service after an eligible experience.
Reviews should be:
- Genuine;
- Based on your actual experience;
- Honest;
- Relevant;
- Fairly expressed.
You must not:
- Submit a fake review;
- Review a service you did not receive;
- Impersonate another person;
- Manipulate ratings;
- Threaten or pressure an instructor concerning a review;
- Include unlawful content;
- Include unnecessary private or sensitive information about another person.
Real Drive may moderate, restrict or remove reviews where reasonably necessary under its policies or Platform Terms.
20. Complaints and Disputes
If you have a concern about a booking, payment, instructor or Real Drive service, you should contact Real Drive through the available support channels.
We may request relevant information from you, the instructor or other appropriate sources in order to investigate.
You should cooperate reasonably with an investigation.
Where the complaint concerns driving instruction provided independently by an instructor, responsibility for the underlying instruction may remain with that instructor.
Real Drive may nevertheless assist with communication, payment or platform-related matters where appropriate.
Nothing in this section restricts your statutory rights or your right to seek another remedy available under law.
21. Accidents and Serious Safety Incidents
You should notify the instructor and, where appropriate, Real Drive as soon as reasonably possible about a serious incident connected with a Real Drive booking.
This may include:
- A road traffic collision;
- Serious injury;
- A significant safety concern;
- Police involvement;
- Significant vehicle damage;
- Other serious incidents relating to the lesson.
Where emergency assistance is required, contacting Real Drive is not a substitute for contacting the emergency services or another appropriate authority.
The instructor is responsible for dealing with vehicle and insurance matters that fall within their responsibilities.
22. Personal Information
Real Drive processes your personal information in accordance with its Privacy Policy and applicable data protection law.
Information reasonably necessary to arrange or provide your lessons may be shared with your instructor.
This may include:
- Your name;
- Contact information where necessary;
- Booking details;
- Pick-up or meeting location;
- Relevant lesson information.
You must not misuse personal information relating to an instructor or another Real Drive user.
Please read the Real Drive Privacy Policy for further information about how your personal information is processed and your data protection rights.
23. Account Suspension and Termination
Real Drive may restrict, suspend or terminate your learner account where reasonably necessary.
Reasons may include:
- Serious or repeated breach of these Learner Terms or the Platform Terms;
- Fraud or suspected fraud;
- Payment abuse;
- Misuse of the platform;
- Abuse, threats or harassment;
- Repeated booking abuse or non-attendance;
- Manipulation of bookings or reviews;
- Serious safety concerns;
- Providing deliberately false information;
- Unlawful activity;
- Security concerns.
Where appropriate, Real Drive may provide notice or an opportunity for you to respond.
Immediate action may be taken where reasonably necessary to protect users, maintain security, prevent fraud, comply with law or address serious misconduct.
Suspension or termination does not affect rights or obligations that arose beforehand, including outstanding payments, refunds, bookings or disputes.
24. Closing Your Learner Account
You may request closure of your Real Drive account.
Account closure does not automatically cancel outstanding bookings, payment obligations, refund requests, disputes or other existing obligations.
Certain information may be retained following account closure where permitted or required by law, as explained in the Real Drive Privacy Policy.
25. Real Drive's Role and Responsibility
Real Drive provides the technology and related platform services used to connect learners and instructors.
Unless expressly stated otherwise, Real Drive does not itself provide the driving instruction delivered by independent instructors.
The instructor remains responsible for the driving instruction they provide.
Nothing in these Learner Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Learner Terms excludes or restricts statutory consumer rights that cannot legally be excluded or restricted.
Real Drive's general responsibilities relating to operation of the platform are also governed by the Real Drive Terms of Service.
26. Events Outside Reasonable Control
Lessons or platform services may occasionally be affected by circumstances outside the reasonable control of Real Drive or the instructor.
These may include:
- Severe weather;
- Dangerous road conditions;
- Road closures;
- Vehicle breakdown;
- Illness or emergencies;
- Government restrictions;
- Major technical failures;
- Significant third-party service failures;
- Other comparable unforeseen circumstances.
Where possible, reasonable steps should be taken to communicate disruption and make appropriate arrangements.
Any payment, rescheduling or refund rights will continue to be determined by applicable terms and law.
27. Changes to These Learner Terms
Real Drive may update these Learner Terms where reasonably necessary, including because of changes to the platform, services, business operations or applicable law.
Where a change materially affects existing users' rights or obligations, Real Drive will provide reasonable notice where appropriate.
You may be required to accept materially updated Learner Terms before continuing to use certain services.
The current version and last-updated date are displayed with these Learner Terms.
28. Relationship With Other Real Drive Terms
These Learner Terms apply specifically to your use of Real Drive as a learner.
They should be read together with the Real Drive Terms of Service and Privacy Policy.
Specific terms presented for a particular booking, lesson pack, intensive course, promotion or service may also apply.
If there is a conflict between these Learner Terms and specific terms clearly presented for a particular service, the specific terms will apply to that service to the extent of the conflict.
Nothing in these Learner Terms overrides rights that cannot legally be excluded or restricted.
29. Governing Law
These Learner Terms are governed by the laws of England and Wales.
If you are a consumer, you retain any mandatory legal protections and rights that apply to you.
Any dispute relating to these Learner Terms will be subject to the jurisdiction applicable under UK law and any mandatory consumer rights.
